I would say so. If you eventually succeed (with both the permissions and the rescaling) then I would urge that you add "Garden RR Scale" (or similar) to both the asset names and descriptions otherwise you will get lots of complaints about the oversized, gigantic weeds on steroids that you have created.
@coop2 - To make a Garden Model Railroad, you need to make scale objects for decor.
There are already quite a few scenery items available on the DLS for making a Garden Model Railroad.
@KotangaGirl may be the one to ask, as I think she has made some Garden MRR scenery.

Thanks for all the input. KotangaGirl checked out your garden rr very impressive. I'm going to copy and try to modify the size of some Trainz assets. If this works I'll start looking for permission from orginal designers to modify their assets. I know that I can change the 'mesh-scale' of an asset. I'll try to keep in touch as I go along. Can soneone tell me some of titles of assets that would fit in a garden rr in DLS?

The agreement we came to at the time was that garden sized buildings and other assets intended for garden railways should have 'GR' in their file names. Likewise assets made specifically for model railway use should have 'MR' in their file names.

Checking just now on the DLS in the 'layouts' menu and using 'garden as a key word in the description tag I found a very small number of garden layouts which may or may not be useful.
In the 'buildings' menu using 'garden' as a keyword again you'll find Ray Whiley's garden assets. All the file names begin with DDD GR.
I know some large trees and other models were made for garden railways around the time I was making my own layout and searching through the posts in the Trainz Model Railroad forum is likely to turn up something for you.
KotangaGirl thanks for the help. I'll check it out. If an asset designer doesn't include contact information do you think they care if I change the 'mesh-scale' in a copy of their asset file with my kuid ID. I guess I could include a statement 'adapted from "asset designer's Kuid ID"

Unless a modified asset is only for your own personal use you really do need to get the asset creator's permission before making any modifications. I know sometimes that's not possible, but their copyright has to be respected.
One idea might be to download Garden Railroads by other authors and that would not only give you perspective, but get you a whole bunch of assets at once:

Again thanks KotangaGirl. Thanks Forester, I'll check out all the garden rr you listed to use their assets and get ideas. I did download a garden rr, author is veggiewolf2, copied the Route and deleted all, leveled the ground and going to start over with my garden rr. Thanks again for veryones help>

When I started with this, I added "HUGE" to the asset name. Didn't really get picked up by a lot of people (and maybe I didn't think it through long enough), but a few did.
