Don't upload the files here without their permission.

The best course of action would be to reach out directly to them either via email (typically there is one listed in the config file) or via Direct Message here on the forums.

If those (or any) members would no longer be active, keep in mind that copyright stays active for 75 years in most countries.
However...
In that case you could consider contacting the Content Repair Group (if content is really broken) and they can (via N3V) upload fixes (after testing, etc) under the name of the original creator. But only if content is already on the DLS and broken in a more recent version of Trainz.

I agree totally that respecting the creator(s) rights is paramount in this matter. But in this case, Ben's SD9 is not yet on the DLS but I expect him to upload it sooner or later. He has updated and uploaded quite a lot of stuff this past year. With regard to the USLW content, I believe N8phu has been given permission to update it and make it available from his website. But he has struggled this year with family issues that of course come first always. Now I agree having these items on the DLS is the best option but having repaired all the USLW content myself a few years ago for personal use in TANE, their stuff is very dated in appearance and N8phu will both fix the errors and reskin the items to improve how they look in game. It just takes time.

I'm pretty sure Ben has changed his terms to allow mods of locos , I've asked him about a few and he's never objected,A number of his Uintah locos have been updated by various folks over the years and are on the DLS

Here is the current license on a box car uploaded this year by Ben. Fixing errors is not the same as a reskin. Seems to me the proper thing to do is ask and not assume permission is granted. Since the issue here is the loco has errors which prevent its use in newer versions of Trainz. Ben may well be working on the fix himself. I'm sure it is better to have the original creator issue the update rather than someone else.

I downloaded the CoG SD9 from Ben's site and here is the license. It is similar but different than the one above. It seems Ben has gotten more restrictive rather than less but he is still only granting permission to reskin.
