copyright advice

Don't know if I am in the right forum here - don't hesitate to put it anywhere where might fit better.

I need some advice on copyright matters with one project of mine.

What I want to do is provide some software to build animated switches / turnoust where the user can define geometry and select the texture to match adjacent pieces of track. As I am fearing to loose my job I think of this as payware.

Workflow would be something like

- define geometry (i.e. radii, angles)
- define the tracks that the textures should match by kuid
- run the software.

This would give a new item of fixed track under the kuid of the user but incorporating textures from other authors available with the track from DLS or anywhere else.

If the map was uploaded these new fixed track items would appear on the DLS with said textures included.

Would this infringe the copyright of the original track authors ??
Would the user in any case have to ask permission of these authors prior to uploading ?

You are reusing some one else's textures that they may or may have a restrictive copyright on.

Each case would be different.

For personal use I think it's fine but if it was uploaded then the uploader would be responsible for sorting out the copyright issues.

I'm having difficulty working out how you'd pick up the textures, they don't use the same standard names. If it was freeware then many content creators will give permission for you to reuse their track textures for free. If its payware then a whole different set of rules kick in. For example quite a few of my textures I have permission to use on freeware items but I may not use them on payware. Also I have permission to use them but I do not have permission to let some one else use them.

That is not too difficult. The user would have to specify the kuid of the track he wants to connect. Reading and using the kuid of this asset would give me enough information on how to read and apply the texture.

My prog would be payware - if ever I am going to do it, that is. The track however coming out of it would be an item of the user - and this would be freeware unless the user decides to upload his map as payware.

So in the end, it would be the user to use the texture of somebody else on a freeware object (that would be the track) of his own with help of my prog.

Does this make any sense to you ?

That would be my interpretation it would be the responsibility of the person uploading to worry about the copyright side. Your tool is a tool and as such could be used by me to create payware legitimately from track that used my own textures if I owned the copyright.
