I have sort of the same thing with a video I made for my girlfriends birthday....but its not a public video so I really don't care what happens...
And if the world was strict about that, Youtube would have died years ago, at least as far as video games are concerned
Video Games are not a valid comparison. How many times has someone taken a Trainz video of yours and been able to rip it and acquire a free copy of Trainz with everything you have available?
From a practical point of view, copyright is a civil, not a criminal matter, so it's generally up to the copyright holder to complain / sue if you break copyright. Some companies are much more inclined to do this than others (hence so much copyright material on YouTube that hasn't been taken down). Some companies see it as free publicity (there's plenty of official videos posted by the record company). As pommie says, you don't have the right to upload other's music in this way, so if you choose to do so, and get busted, don't complain (at least now you know what the law is).
I would have certainly thought that using public domain music (or that in which the copyright has lapsed), would be the safest option. Alternatively, I'm sure we have some gifted musicians amongst our ranks, performing their own compositions - perhaps some of them would like to make some of their tracks available (with all the right acknowledgements) to Trainz video makers, and perhaps get a bit of extra exposure along the way...

perfect example...I put one of my earlier videos to a John mellencamp song....when it was uploaded Did not get a thing about copyright untill 5 months after loading...now Look at the arrangement....Buy song....And a advertisement.

This is the part of youtubes 'Terms Of Service' that everyone agrees to when they create an account with them.

And if you read C it states that you grant anyone the right to download, and use however they wish, any content you have uploaded.
