Hi All,

I'd like to know if there is a definitive resource available which advises what one must do to safely and legally upload a File (in this case a Route) for TS2010 onto the DLS?

I'm currently working on two massive Routes for TS2010, one for the West Coast of the USA & the other for the East Coast. Both have taken more than 2 years to build, and both have enormous numbers of assets of which 98% have been downloaded off the DLS as Freeware, the other 1% from other third party websites & the last 1% from JR as Payware - mostly Loco's. I think the only other Payware items I have included on one of these Routes is a few buildings from the former Cumberland Trainz site, which I understand is no longer available (do correct me if I am wrong).

This will be the first time I have ever uploaded any content onto the DLS, but before I do, I need to understand what the risks are so that I don't end up seeing a situation where somebody recognises their content within one of these Routes and flies off the handle because permission wasn't sought! I'm trying to be very careful not to offend anyone and to give all the proper credits to those creators out there whose material I have used.

I've also read that once an asset is uploaded to the DLS, that it becomes the property of NV3 Games and cannot simply be removed if a scenario described above, does eventuate.

Any help will be appreciated!
 
As long as you don't package the other content with the route itself, there are no legal concerns. The route (and sessions as well) are merely references to content; they do not actually contain the content. And, since you made them, there are no legal issues.

I think Leeferr of CumberlandTrainz uploaded some of this former payware to the DLS, at least some buildings. I don't know if he changed the kuids, but take a look.

At the very least, uploading any payware from anywhere is a no go.

He isn't uploading payware and comments like that serve only to muddy the waters for an uncertain first-time route builder. Edit see also the next two posts!

@ Rik: Uploading a route and/or sessions in NO WAY compromises any other asset or the license thereof. Permission is NOT needed for the use of any asset (freeware or payware) in a route if the asset is used as supplied by the original creator. When you distribute your route you distribute ONLY your own work. As RRSig says, your route merely references the assets used. The assets are not included in your route nor distributed with them. The same applies to sessions.

If the only payware you have is rolling stock, then your route contains no payware. The rolling stock is part of the session, not the route. If your route is showing rolling stock as dependencies then you should get the trains back on the session layer where they belong!

Your session will contain payware, and it is normal to advertise that fact when distributing the session, but you are NOT re-distributing the content so there is NO issue. Anyone downloading your session will be required to buy the payware assets, but that is between them and JR and has nothing to do with you.

In short you are Scott free my friend, upload away!

Dermmy. I do appreciate the response, but I have carefully read the OP and was advising to be carefull about the payware. In no way was I trying to muddy any water or imply anything negative. Just friendly advice.

Oops = I just re-read the OP and I see your point - sorry!

@ Rik (again) - the ex-Cumberland payware route assets are not a problem in so much as your route (again) merely references the assets, they are not distributed with the route. If the assets are unavailable though then I'd be changing them out for something else. This has nothing to do with their Payware status, but any un-available asset will give you nothing but grief from the zillion "I can't find it" posts you will get. marrufijd's advise is against being tempted to re-distribute the un-available assets with the route: that would be a total no-no...
