All Trainz Content that has ever released has the right to remain publicly available who's with me?

There is a cottage industry of taking books and or manuscripts that are in the public domain and re-packaging them for sale. Sometimes a great deal of work goes into translating such works that are in a different language to English and sometimes it is just a matter of loading the archaic text into Microsoft Word and using the grammar and spell checker to update it to modern English. A bit of formatting and an AI generated cover and you have an eBook. What you are paying for is the convenience of having the work done for you. Much like paying someone to deliver food to your home when you could go pick it up yourself.

Exactly what right does anyone have to another person's work? Just because someone publishes an item at some point does not mean they must continue publishing it forever. I am speaking of 3rd party items of course.

Only as far as the rights implied in the act of purchasing or legally obtaining a copy of that work.

In the past things were simple - a work was published in a physical form (i.e. a book, manuscript, artwork, etc) that was difficult or even impossible to duplicate using the technology of that time. The implied user rights would be personal use only. You can read the book, hang the artwork on your wall, or give it as a gift. It always remained a single copy.

Art has been a particularly interesting area. You can buy an original artwork for a pittance from a young struggling artist. Keep it a few years and when/if that artist becomes famous you can sell it for a squillion. The original artist (or their family) never gains any financial benefit from these 3rd party sales - except perhaps increased fame.

Today copying and redistributing an original work is easy. It is also easy to manipulate that work for any purpose.

I have a couple of questions, in this thread it seems appropriate.

First, I converted the outdated <kuid:107727:1181> Amtrak Pacific Surfliner route to TRS19, replaced the trees and buildings. I didn't change anything else on the route.
I wrote to the author's PM and to Email to get permission to upload this to DLS, but he did not respond.
There is nothing about the prohibition of use in the route config. In this case, can I upload the route on DLS without the author's approval?

And the second question is, there are a lot of outdated Auran routes in the DLS, such as City and Country USA, redesigned by various users.
Do I need to get permission to upload such a route to the DLS?
 
Ironic, since several copies of other Surfliner routes are uploaded to the DLS, but that is common practice for mobile users. No policing on that end I guess, or maybe that is allowed for mobile.
 
I agree with those saying that it should be up to the route's creator if they want to release it or not. It is up to the individual creator whether or not they want to keep it up after they leave the community. As a route builder, I choose to release some projects, however choose to not release others for a number of different reasons. If I was to leave the community, I know that I definitely wouldn't want my own content being out there and people thinking they can do whatever they want with it. It is my route and only I can grant permission to release my routes somewhere.

I make modifications to various games and post it in several places at once so that as many people as possible can take advantage of it.
And I always make a note that you can distribute it anywhere in any quantity without any restrictions with a note about my original authorship.
That's why I asked above about it. I just don't understand why should make something and then hide it from everyone.
I can't find a reasonable explanation for this behavior, maybe I'm just an idealist or I even worse. :)

Since no one seems to have offered an answer to that one I will throw in my 2c worth.

I would read the creator's instructions that are usually found in the config.txt file. If it says something like ...
  1. "free to modify and release" then the answer is YES. As a courtesy I would include the name of the creator and the original <kuid> in the description of the config.txt file.
  2. "for personal use only" then you can modify as much as you like but not upload.
But if there is no comment or statement on the matter then I would apply the "for personal use only" condition.

You could always send the creator a message politely asking permission to upload your modifications. I have always done this and usually have received a positive response. If you do not receive any response then I would apply option 2 above.

I was wondering if there are official rules for posting content in the DLS with a specific explanation of what is allowed and what is forbidden.
I just haven't found it anywhere.

If you don't have specific permission then you can't do it. Konni created a very nice German layout with rolling stock etc. Last I heard he was at stage 4 terminal cancer and he'd lost the movement of his legs, but there was no permission to do anything with his assets. There in one content creator I work with who has said if he is out of contact for more than six months then his content can be cloned and uploaded to the DLS. He's in his eighties. I hope he'll be in contact for a good few years as I happen to like his creations.

Not all opinions have any legal validity. Unfortunately we can't just do what we want with other people's work unless they have specifically allowed it.

Otherwise my best advice would be to get yourself elected to public office and change the law. But you would then have to negotiate with every other country to get them to do the same.

Well if you want to be pedantic - for anything I made: NO. There it is, simple and to the point. As to why - because I say so.
Oh and my stuff, for what it's worth, is not hidden from anyone, it is freely available on the DLS, for anyone to use.

I also know that once a copy exists anywhere away from my computer, all real control is a fiction. We all rely on the honesty and good manners of Trainzers to respect every creator's wish. If someone goes rogue doesn't, well may bad karma follow them until the end of days.

Yeah translating to American English can be difficult. I mean why would they rename lifts elevators?

I wanted this to happen for MSTS models that were officially released and removed for unknown reasons, I had a argument with Yuri "RIP" the founder of Steam4me to release Team-ALCO's modern freight pack as freeware since it was once payware. In the end Yuri ended up releasing the modern freight pack as freeware, which took me by surprise, but overall! I do agree with the statement "Once it's been released, it should therefore remain to be released".

I would even love to see Davido, make available all of his ex-payware V Sets. They are still amazing models and work well in TRS19/TRS22! There's so much I would love to see re-released for MSTS, Railworks/TSC and Trainz
