My take is that it is not behind any paywall or other mechanism to restrict its distribution. Especially if it was once available but then removed because of (you pick the reason).Define publicly available please.

Not necessarily, if that latest version doesn't work with an older Trainz. When I update an item to the DLS, the DLS automatically obsoletes the older version but it is still available for those that need it.As a content creator I assume you want end users to have the latest version.
As soon as a copy is out in the wild, what real control do you actually have? I gave up that notion long ago. If someone is determined to copy/modify one of my objects, there is little I can do about it other than point it out here and hope others ignore it and if it ends up on the DLS as the creator, ask that it be removed.So to keep control

Found none on the DLS and one (<kuid:248438:101110>) on a well known Russian pirate site. My browser gave me a warning "Did not connect. Potential security threat".

So? Just because the public can see it doesn't mean you can do with it as you please.
"(available to the public without any restrictions)" Well no for the reasons documented above. Another big problem is storing all this stuff.
