My take is that it is not behind any paywall or other mechanism to restrict its distribution. Especially if it was once available but then removed because of (you pick the reason).
I don't see it being in the public domain. The creator of the item still "owns" it. Like my stuff in the DLS, I own it but anyone can use it in their routes.
 
Is it not the whole purpose of the Download Station to make and keep things available? Even if a creator asks N3V to remove their previously uploaded content, N3V have a policy not to do that.

If it's about content on third-party sites, that's an entirely different proposition.
 
My assets that are on the DLS are free for anyone to use. I even have no problems with them being redistributed though 3rd party sites except if it is for payment (N3V DLC excepted) or if payment is required for accessing the site.

But I do not relinquish my ownership rights over those assets until the copyright legally expires as it does for all copyright.
 
As a content creator I assume you want end users to have the latest version. This isn't always the case for third party sites. So to keep control some content creators will only allow their content to be downloaded from their site. Then you get to the problem that you thought you had permission to reskin but in fact you didn't so the reskin has to be taken down. You can't do that if there are multiple copies everywhere.

The DLS doesn't work for some content. Typically texture copyright.

I see too many problems here and currently there is nothing to stop a content creator saying his content is cc-by-ca but the latest versions do allow the content to be sold for profit.

Not necessarily, if that latest version doesn't work with an older Trainz. When I update an item to the DLS, the DLS automatically obsoletes the older version but it is still available for those that need it.
So to keep control
As soon as a copy is out in the wild, what real control do you actually have? I gave up that notion long ago. If someone is determined to copy/modify one of my objects, there is little I can do about it other than point it out here and hope others ignore it and if it ends up on the DLS as the creator, ask that it be removed.
 
Ah, the plot thickens. Some self interest or conflict of interest to say the least.
Irrespective of that, the concept is still a valid one if it is done correctly and not via a pirate site
 
I am NOT with you. I am even strongly against this.
Why?
Partly because it simply is against various laws in various countries and partly because of my own personal opinion.

There is even some content that shouldn't even have been released in the first place (though of some of it you could wonder if it even meets the definition of "content" or at least for this topic).
 
So reskins. I didn't go down the rabbit hole to see if the original creators allow this and whether they have been credited. Also, not the most intuitive site to find Trainz stuff. If I was interested in TTTE and it wasn't on the DLS, I would probably no look here.
 
It's pretty obvious that the OP comes from a place where there are no copyright restrictions and everything that's yours is mine and free for all. Unfortunately, this isn't the case in other places in the world. Copyrights and protections allow the original creator, publisher, and owner to determine how and where their works are distributed.

There are set time periods to allow a creator to benefit from their work whether it's through notoriety only, as it is with freeware and public domain, and monetarily with payware and published works through a publisher or distributor. Eventually, these periods expire after a set number of years for the original author, however, families and in some instances, others associated with the works can hold restrictions on the distribution. My late father was a fine artist and graphic artist who made a living painting and producing artwork and illustrations for various firms and individuals. If there were no restrictions on distribution and everything was made public, we would've starved to death.

Today, it doesn't matter whether this is digital or physical. This is the same for both media.
