Warning to users downloading content by Bort85 - Please Read

Three pages in less than one day on this thread, and no response from N3V - I say that equals complicity in what Bort85 is doing. Nice demonstration of ethical behavior N3V.

Relax, Mr. Expert programmer with All the Answers. This isn't the only issue here.

No one here even though about the hashing system til I told you. Said system would be near impossible to implement system-wide, which is why nobody does, not even the big boys like Google.
 
I had an entire diatribe about your response to me, but I have decided to just sum it up thusly - you must be a petty, petty man to attack someone that said nothing to/about you.

2. If you are not the copyright owner, but believe that the content is uploaded illegally, please contact the copyright owner with your concerns. We are generally not able to take any action without a specific claim from the copyright owner.

3. Please avoid making accusations about other users, groups, or communities, or N3V. It's not very friendly, and it may open you up to legal liability if your accusations prove to be incorrect.

That's a good point, I just now googled trainzup and get this;

How do we even know that the two guys uploading this stuff don't actually own it? Is there another TrainzUP someplace? If so, has anyone contacted them?

Thankyou for your input.

I will see if I can contact the relevant copyright owners, but I have a feeling that it is not going to be easy as some of them may not even use the forums.

In the meantime, can something be done to temporarily prevent downloading of items by Bort85 until the matter is resolved one way or the other? Bear in mind that it's not all from the same place, and quite a bit of it is from third-party sites who may not want their things on the Download Station.

A further twist to the tale...

I've just done a country search on said user and it appears the user is Russian, so that may or may not explain why the Russian content is being uploaded.

It does not however explain why said user is uploading non-Russian content as well.

I reskinned (with permission) Frank's ES44s into the HIII paint scheme a while back and uploaded them to TPR and about a month ago they were found on another site when I did a google search. I clicked on the download link but the link was broken or something. I didn't catch the "creator's" name but it probably the same guy.

Probably maybe allegedly, when I first saw this thread I assumed that we knew for a fact this stuff was pirated, in the future I would suggest holding off until there's concrete evidence of that.
 
Let me see if I have this right:

Asphalt1,<kuid:703319:100345> by bort85 looks exactly like Asphalt1,<kuid2:151900:500100:1> by blue_sky_interactive (which is built-in).

As long as blue_sky_interactive doesn't complain about it then it is a fair upload?

So then I can just wait a bit for the dust to clear then upload my own clone of the asset?

Not that I plan on doing anything like that, what's mine is mine and what isn't isn't.

Doing something illegal without being caught does not make something legal.

Can we bring the thread back into context please. As it stands, it looks like the owners of the affected content will need to contact N3V directly, which I strongly urge them to do.

It's the only way we are going to be able to fight the battle of illegitimately copied content being uploaded to the Download Station.

The screenshot on P2 looks like the built in Russian trees - bereza and derevo etc. from TS12.

As a content (route) creator myself, must say I am a little dismayed at N3V's lacklustre response. Copyright theft is a very serious issue, regardless of whether it is freeware or payware. I would expect N3V to take action if they have been alerted that a route I created had been cloned and uploaded under someone else's username with no permission from myself. That has always been an unsatisfactory aspect of the software, IMHO, and it should be much harder to change ownership of an asset - I have seen it myself when Trainz creates a new version of route on doing a small change, the owner becomes you which should not be the case. It should certainly not be possible to upload a "new" version of someone else's asset without there being a check in place that this is with consent of the original owner. How hard would that be to implement? No permission, no DLS upload and if that is because the original creator has moved on and can't be contacted - tough, no upload.

N3V also need to be very aware that while opening up the Russian market has brought in some very talented creators, it is also a society where intellectual rights and copyright violation are seen as the norm (just look at all the cheap MP3 sites) and that needs to be adequately policed.

Failure to take copyright theft seriously will lead to creators not bothering, uploading elsewhere or going off to work in another sim where assets can be protected more effectively.

I would think that unless you are cloning stuff without permission or if you do have permission, not stating so in the description then there is no need for any concern. Most people are not uploading hundreds of copies of already available items and are hardly likely to be.

Which is why it would be better to have safeguards in place before such content gets anywhere near the place.

Coming back to the points I made:-
1. It is far too easy to move a tree 10m on a route, save it and make the owner you.
2. The DLS needs a built in check when accepting modified content from a third party that permission has been given. That might be in the form of an automated email to the original creator with a link to click and confirm their acceptance, or a manual flag to the file librarian to do the same. Either way, the re-owned content goes nowhere until that step has been taken.
3. It is not acceptable for N3V to sit on their hands and wait for the original creator to contact them. If an alert has been raised they need to at least start making enquiries and block/remove the affected content until the bona-fides are validated. The original creator might be on holiday or away from the PC for a few days but that should not entail waiting for the creator to return. If I was away for a few days and someone spotted one of my routes under someone else's name because they planted a couple of extra bushes, I'd want it sorted PDQ.

Sadly this is no longer a small community of several score people who create and upload content, belonging to a tight knit group where we know and trust each other. Those days are now long gone and N3V need to start taking copyright seriously. I'm sure they would act fast if someone started uploading items from one of their payware routes, so extend the same courtesy to freeware providers. Otherwise, the T&C for the DLS in addition to allowing N3V to requisition your work for themselves, needs to say we cannot guarantee your work will not be plagiarised by others or that we will take any action when it appears on the DLS.
 
I'm now beginning to regret creating this thread - it seems to have gone downhill, when my main intention was to make people aware of what the user mentioned has been up to, and to try and get N3V to take responsibility for sorting something out.

It seems that whatever I seem to do lately does not go to plan.
