Reskinning WEN's class 142

Hi all

I wrote to Wessex_Electric_Nutter about 2 weeks ago asking if I could reskin his Class 142 for my own use. I also asked if I could then upload it. I'm not saying he is ignoring me because I understand he is very busy, I'm just asking, do I need to ask his permission to reskin his fantastic 142 model? And do I need to ask permission to upload it to the DLS? I would really like to get a few reskins done such as a Northern Merseyrail, Northern FNW, Arriva Trains Wales, FNW star-lvery, FGW and FGW plain-blue (to represent the Longrock TMD - Newton Heath TMD stock move)

You do not need permission to reskin something for your own private use.

You might need permission if you want to distribute the reskined asset in some way, such as uploading to the DLS, putting it on a www site or giving it away to friends. It depends on what has been included in the comments within the asset. The author might have given permission for distribution, perhaps with limitations (such as non-commercial distribution only, or DLS only). If the permission isn't there, then you would be infringing the author's copyright if you distributed it.

On the CM there are no uploads by Wessex_Electric_Nutter himself. There are several reskins by the creator "redmanb11" and the disclaimer in those say:

"*Final Version* Includes working AJS Superstub Script.
Class 142 BR 'Skipper' cream and brown Livery by Redmanb11. Mesh and original textures by Wessex_Electric_Nutter.
All Dependancies are Built in to TRS2009 and DLS."

It mentions nothing about asking permission so I've no idea what to do to be honest. I just want to give something back to the Trainz community, however small, and I've messaged WEN a fortnight ago and he hasn't got back to me so I'm a bit stuck on my next move :(

If I understand correctly, you have nothing (assets) directly from WEN, but want to repaint a repaint...

Builder Bob has already answered your question, regardless of who the original creator is, or who the repainter is...If no permissions are specified in the Config file of the asset, you must ask the original creator..(which you tried to do)..the lack of responce is essentially your answer, regardless of why...until you get a "YES" from the original creator, you can NOT distribute publicly, by any means, anything that you "repainted".

For your own personal use, you may do as you like...you just can't share it without explicit permission...lack of communication is NOT permission.

To dally it up even more, to repaint a repaint of a repaint, you really should be asking for permission of all previous repainters, plus the original content creator.

What someone else has done with this asset does not affect what you can do with it, other than perhaps suggesting what the author's response might eventually be. But until you get that response you can only do what the authorisation inside the asset allows you to do, and if distribution is not mentioned then it would be infringement of copyright to distribute.
 
Thanks for the help guys :) as I would be reskinning a reskin, but would not be using any original parts of the previous reskin (I would colour the whole thing white before starting my reskin) this means that I would not be technically reskinning that skin, just reskinning the mesh, therefore I would only have to ask permission from the creator, oui?

I'll start some reskins off for my own use, and if WEN gets in touch with me and asks me to delete them then I will be more than happy to :)

Recoloring someone's repaint white, then painting your own colors atop is still using that persons contribution...as without the original work, you do not know if something was changed by that second party, such as more detailed grills, or movement of door lines, or, whatever...you are still repainting a repainters work, and they still need to provide permission.

This is a very good example of why it is NEVER a good idea to repaint a repaint, ever. The original work should always be available somewhere, and if it isn't, there might be a reason why, such as the original author may have left the "scene", and does not want ANY of their work redistributed, even repaints of repaints that they may not even be aware of.

Anyone can "claim" they had permission to do something when an original creator is MIA... Good judgement says avoid such works.
 
Well in that case, I'll contact redmanb11 too to see if he'll give me permission to reskin his contribution. Of course, it still all depends on whether Wessex_Electric_Nutter grants me permission in the first place to reskin his 142 mesh. I can't find any 142's on the CM by WEN, and I can't seem to get the hang of his specific website. Looks like I'll have to put this on hold, or even cancel it altogether.

like we both said previously, you can do anything you like for your personal use ( I have dozend or repaints of payware stuff I bought), you just can't share it without permission.

Got a link to the WEN site, maybe I can take a look and help advise.
