The way the file reads on his 4-6-2 you cant reskin it and upload to the DLS, is that correct or am I reading it wroung? Also not sure on policy on his SD-9 low nose version. I tried emailing him the other day but have not heard back. Thanks in advance.

The license for the NYC 4-6-2

You may not sell this package. You may not claim it as your own. You may not upload this to any other website without my permission. You may repaint it if you wish, just alias the original asset. Do not include the mesh. You may reuse parts of the textures for your own projects as long as you mention the source in a readme or the description.
All items are presented as is, no warranty is included nor implied. I doubt this would cause any damage to your computer, but if it does I may not be held liable.
The contents of this package are copyright 2010 Ben Neal, unless otherwise noted in the readme.
Thank you for your cooperation.

You may not sell this package. You may not sell any reskins of this content, either. You may not claim it as your own. You may not upload this to any other website without my permission.
With the nots out of the way, you may repaint it if you wish if you give credit for the original and let downloaders know where to find the dependencies. You may reuse parts of the textures for your own projects as long as you mention the source in a readme or the description.

The contents of this package are copyright 2010 Ben Neal, except for the human meshes, which are courtesy of the late Max Nelson, the sounds, which are thanks to either Tony Weber or Bill Fock (indicated in the readme), and the scripts, which are usually from Bob Pearson. The readme contains mentions of any other thanks, and can be located in the locomotive asset.
Thank you for your cooperation.
My reading of these seems to indicate that you can clone the #750 and repaint it and upload it to the DLS only. You can not clone the NYC locomotive apparently. You can not upload dependencies.

Ben's License for the chop-nose SD9 is fairly clear to me and is on both his web page that hosts the files and in the readme included in the files.
License:
Feel free to reskin this and release it when and wherever you like as freeware. All I ask is that you indicate where to find the original package and also include the original readme which credits the authors who have contributed to the creation of these assets. Do not clone unmodified dependencies and upload to the Download Station or other website. Updates of the included assets to T:ANE standards by any party are not allowed without my express permission. The enclosed assets may not be used by any payware content without permission. The included content is copyright 2016 by Ben Neal, except as otherwise specified in the readme.
Ben bends over backwards to allow reskinning his assets, he even includes the psd file for reskinning in the SD9 files.
What you have to do is;
Credit BDANeal and include the url for SubPar in the Description section of your config.txt
Include the original readme included in the SD9 files
You may not clone BDANeal dependencies for the SD9 and upload them to any site unless you modify them. You can link to the dependencies on BDANeal's website.
Dependencies;
<kuid2:96914:50941:3> Flexicoil Truck Blue
<kuid2:96914:980017:2> Class flag green flying
<kuid2:96914:985001:1> Freight Hoses
<kuid2:96914:980018:2> Class flag green furled
<kuid2:96914:980019:2> Class flag red flying
<kuid2:96914:980020:2> Class flag red furled
<kuid2:96914:980015:2> Class flag white flying
<kuid2:96914:980016:2> Class flag white furled
You may not update the files to TANE standards without written permission from Ben.

Hi Norm --

I don't have the time to do a detailed search of these Forums, but Ben made a post relaxing those constraints. I strongly emphasise that these are my own words but it was along the lines "I now realise that I've been very anal retentive. Feel free to modify and upload my content to the DLS, but please give me appropriate acknowledgement."

And I think that I speak for all of those who frequent these Forums and use Trainz when I say that I'd like to thank Ben for all his wonderful creations.

Thanks for the info. Not sure which of the two 4-6-2's I have will have to check when I wake up. Is there a difference in them?

The read me on the 4-6-2 made me wonder if I could upload it, wanted to make sure I could before I made a mistake.

Would like to piggyback on what Philskene says, Thanks and hugs to all past, present, and future modelers out there, with out you all are lives would much less bright.

I sometimes wonder if N3V should reserve some section of the forums or MyTrainz so that creators can express their current copyright intentions. It would save a whole lot of time.

Yes, Ben made some great assets.

Ahh thanks. The one I have is the one you can reskin, the only thing different in the two as far as I can anyway is the skin on them. Should be uploading it soon, the SD-9 should be done soon.

HI Phil, Do you still have your website with all Bens loco's listed on them and are they TANE proof or still Ts12
Cheers

nimec --

I've uploaded quite a few of Ben's locomotives to the Download Station. All are "TANE proof". Most are narrow gauge. Some are standard gauge. They use my kuid. Search the Download Station with "philskene" as the author. This is one of those narrow gauge locomotives in action:

More standard gauge are available in my DropBox folder. These retain Ben's kuid. For the T:ANE version download this zip file:
