N3V - what were you thinking

Currently, there are advertisers that are pushing the boundaries of the law by adding a small 'visuals shown may not be from actual game play' in their ads, but they have been warned that this disclaimer might not be enough.

Caution, yes, if this was part of an advertising campaign for potential new users who do not currently own a copy of Trainz (any version) but to get the newsletter you have to be a registered Trainz user and owner. My original point about the fact that the screenshot was created using Trainz still stands so it is not advertising anything that is impossible - like those ads for mobile devices that add the "disclaimer" that the visuals shown are "enhanced" or "have time sequences that have been accelerated".

it is false advertising in that a newcomer to this game does not have access to content in sum of the image's used to portray Tane, I'd like to waste more time explaining it to you but i don't have any crayon's

So posts to the "show your reskins" and "screenshot" forums should not be allowed if they show assets or routes that are not yet available on the DLS or on third party sites because newcomers might think that they are available now? I am happy to say that I threw away my crayons decades ago but I am not surprised to see that you have just run out of yours. [my apologies to the moderators for the intemperate language].

See what i mean about going over the top and making a storm in a tea cup, Well that is you not me and don't put word's in my mouth as i never said anything about pic's or post's/threads on this forum being fake or not available, You said that not me and there are pic's that N3V have used in their newsletter's advertising Tane that has content NOT yet available shown on Route's NOT yet available using settings NOT available to your average newcomer and yes they can follow Tram's settings and hope for the best or be a computer expert but the average kid turning up here for the first time would be in for a disappointment compared with what he would of seen in the newsletter's.
Now this is about the third or fourth time i have explained this for you any more reply's and you are just trolling and i'll report it as such.
Mick.

It's irrelevant. Advertisers cannot control the distribution of their material and are not allowed to hide behind a 'local and restricted' distribution excuse. This was tried some time ago by a large retail outlet that claimed it was only distributing the material to its loyalty club members. That defense failed. "Possible" or "Not Possible" is not the criteria that the material will be judged by - it is the much broader concept of 'misleading'.
