I'm gonna vent here

I still give up my seat to ladies, old or young. I open doors for them and I still say please and thank you. The breakdown of society and basic decency is not lost on all and I won't accept the fact that just because so many misbehave, that it's okay.

Mike

I felt old the other day when this really cute chick took one look at me and offered me her seat.

To the OP, I assume that you have spoken with the creator of this content and they have given you their permission to start this thread?
Forget about all the wars and problems with people dying needlessly, never mind starvation and poverty, some mindless yob just reskinned some bloke I might know's train without the correct form filled in.......
Now that I've had my rant I'm going off to do some more curtain twitching
I needed a laugh, cheers for that.

Honesty went out the window, along with giving up your seat for old ladies, opening doors for them and saying please & thank you without fail.

Reskinning without permission, is way down the scale of the crimes in the the world. Blame the people at the top, governments, politicians in general, the police. The whole of society is rotten to the core, top down without exception.
Wow i'm impressed by the level of intelligence and commintment to helping our community police sumthing that the rest of us see as wrong. Let me guess you both play Railworks ?.
Cheers Mick.

Venting, as seen from the ISS.

I agree, at best posting reskinned work without the permission of the creator is rude and inconsiderate; at worst it is piracy. But stopping it or even reliably detecting it, is the problem.

My 2c worth.

No, I blame the person who reskinned without permission. I don't care what the universal standards of honesty or integrity are I still believe every individual is responsible for their own decisions and should accept the consequences of those decisions.

Just because the world is going to hell in a hand cart doesn't mean I don't resist the slide every step of the way...

Happy New Year :)

Andy

:Y: :Y: :Y: My thoughts exactly!

My only comment in this thread, stepping out now...

I was thinking the exact same thing when I read that.

It just makes me think the ones who mock others on this post are probably 12 or 13 years old (at least they act like it) and are pobably the ones who steal others content slam it together, label it as something that looks like garbage.

I'm gonna vent here too

I'm not trying to piss anyone off here but in order for you to protect your stuff then you must register it and pay the fees with the U.S. copyright office in order to have a claim.
see below from the U.S. copyright office.

-------------------------------------------------------------------------
While copyright in the United States automatically attachés upon the creation of an original work of authorship, registration with the Copyright Office puts a copyright holder in a better position if litigation arises over the copyright. A copyright holder desiring to register his or her copyright should do the following:
  1. Obtain and complete appropriate form.
  2. Prepare clear rendition of material being submitted for copyright.
  3. Send both documents to U.S. Copyright Office in Washington, D.C.
Registration of copyright refers to the act of registering the work with the United States Copyright Office, which is an office of the Library of Congress. As the United States has joined the Berne Convention, registration is no longer necessary to provide copyright protection. However, registration is still necessary to obtain statutory damages in case of infringement.
Copyright Act § 407 provides that the owner of copyright in a published or unpublished work may, at any time during the copyright, register the work with the Copyright Office. The purpose of the registration provisions is to create as comprehensive a record of U.S. copyright claims as is possible. To register, the registrant must complete an application form and send it, along with the filing fee and copies or phonorecords of the work, to the Copyright Office.
The Copyright Office reviews applications for obvious errors or lack of copyright able subject matter, and then issues a certificate of registration.
Registration as a prerequisite to claim of moral rights violation: it's not necessary for any author to register prior to bringing suit for violation of the rights of attribution or integrity in a work of visual art, pursuant to Copyright Act § 106A.
Deposit requirement

The United States Copyright Office requires that applicants for registration must deposit with that office copies of the work for which protection is sought. This requirement serves two purposes. First, if an action arises from the infringement of the work, the owner may prove that the material that is infringed is exactly the same material for which the owner has secured a registration. Second, this requirement assists the Library of Congress in building its collection of works.
The Copyright Office has authority to make some exceptions to this rule by regulation, and has done so. Failure to comply with the deposit requirement, as modified by Copyright Office regulations, is punishable by fine, but does not result in forfeiture of copyright.
-------------------------------------------------------------------------

Basically if you don't pay the government then good luck proving it was yours in the first place because the courts are all about proof and paperwork, been there done that.

Like I said before-not trying to piss anyone off but the law is the law!
So if it's not your creation then don't take credit for it!!!
Ask before you upload and get permission first!!
It saves time and trouble for everyone!!

Welcome to the United States of paper work and fees.

The law doesn't state that you must register & pay fees; and truthfully you don't have to, there are numerous cases you can look up where someone successfully sued and won a copyright case without registering with the Copyright Office.

Yes Registering helps, but is in no way required.

Oh really...

 Have you downloaded and viewed the content that uses real photographs for screenshots?

I downloaded the SD75M, to maybe get an error free mesh for Frank's original files and after viewing in PEVSoft Mesh Viewer I nearly threw my hard drive out the window...:hehe:

There is not a word for how messed up the maps were, in fact there was a Erie Lackawanna skin in the file as map0... Imagine a EL SD75? (:udrool: )

That killed the idea of an update because I know that is not what Frank's missing map0 was...:(

The BNSF logo was like someone cut out and arbitrarily pasted it on the side of the hood, with no match whatsoever to the doors...

The long & short of it is that these assets are so bad, nobody but Frank can straighten it out...and who knows what he thinks about it, he may be training someone how to do something, though I haven't figured out what it is...:o

I've seen some pretty crude Paint Shed content, but this stuff makes PS content look like Photoshop CS!:p

That's my $10.00 worth...

Hi All
For those who are attacking N3V for allowing reskins without permission...

The first issue is that, even with a person looking at each upload, there is no way to know if an upload is released with permission or not. Especially if no reference is made to the original author. Hence, policing the uploads is really only valid if the person doing the checking recognises the content being uploaded, and even then contacting the original author is excessively time consuming (especially if you have a large number of uploads that may be reskins that may not have permission),

Hence, we do not check for this during upload for the most part...

However, that's not to say that we support releasing modified/reskinned content without permission.

If an item has been uploaded without permission, then the original creator can contact us to request the content be removed. In the majority of cases, we will remove content that was uploaded without permission from the original author. However, it must be the original creator of the item who contacts us. If a user continuously uploads without permission, then they may be banned, however this is generally not necessary...

Uploading to any website has the risk that someone will modify and release your content without permission.

If someone uploads to a personal website, then you may have trouble with having the file(s) removed, since you will need to go directly to their website host, and they may not actually take action...

I dont get why people are so uptight on their copyrights on trainz, my content is freely distrubutable and people dont need to ask me for permission. Saying that I do ask other users for permission to reskin or modify content, but I find its such a pain in the bum when people have over zealous copyright rules over a piece of freeware.

It makes things harder when that user is no longer active on trainz.
It would improve trainz if everyone was more relaxed reagarding permissions.

There have been many cases when a truly great piece of content hasnt been released onto the DLS becuase the creator is uptight with licenses and permissions.

I think one issue is the word freeware. Content on the DLS can be "referenced" by payware according to N3V. Getting permission to use textures that will be incorporated in payware is different to getting permission to use them in freeware and usually involves paying a license fee.

Also some meshes are created by a group of people so you need consensus within the group. I think one or two of my reskins have needed to be submitted and approved in this way. Also reskins can be of variable quality.

Finally I've been frustrated in the DLS clean up process as some of my work showed errors that hadn't been picked up before. Fine except that some of the people who did reskins have yet to correct the reskins and I can't do it as they aren't under my kuid.

Neither do i know why people get so uptight about their precious content.

They presumably put it out in the public domain for people to freely use, or do they do it just to massage their own ego's ?

I couldn't reskin anything, to save myself being tortured by the NKVD so non of this fatuous debate actually affects me.

If i could create something though, my view would be "do what the hell you like with it".

Toy Trains

Hey..would you stop crying because someone is playing with your toys. The more people doing repaints the better. PERIOD. Why is it that whenever you get a bunch of people together there always are a few that cry like little girls. I'm taking my toys " Pulling my skins" and going home. Go ahead Wyonate pull your skins...I'm sure you pull your skins all the time. Didn't your mommy teach you to share?
Life is tough GET A HELMET.

PS

If the railroads thought the way you do they wouldn't let us copy images of their "property" and we would ALL be pulling our skins. This hobby is based on copying someone elses property. So be furious at yourself and have nice day.
I'm going to do a repaint now...think I'll try fixing one of yours.

Well, what you're referring to is trademark protection and the railroads do in fact think that way when it comes to protecting their trademarks. Just check out some of their websites and view their policies and the forms that are required to get permission from them to use their trademarks. This is not the same issue as copyright protection.

This trademark/copyright issue has been debated endlessly on these forums, but it always seems to raise its ugly head. The wannabe lawyers around here go back and forth on the subject without any real resolution. I could throw my opinion in here from years of experience with copyright, but I'm not going down that road yet again. Just do the decent thing and respect the original creator. Ask permission before releasing.

Ok, to start off with, you're just another disrespectful turd. 2. You sound like you are, I'm guessing here, 10 or 12 years old so what would you know about life. I work for a short line AND own a construction company so DON'T be telling me how tough life is. 3. It sounds like you're the one who needs a helmet, and while you're at it, quit licking the windows on that bus you are riding on. 4. I do share my "toys". Ray Charles can see that my skins are still up. I'm guessing that if we put your brain on the edge of a razor blade, it would look like a BB on a highway. But I doubt you'll understand that because you obviously don't understand the point of this thread.

Try creating something then after you make a few things that looks like legos and after a few years you finally figure it out and someone trashes it then come back and answer on this post.

(I didn't know this was a spelling bee)
