Therefore, N3V cannot impose whatever rules they wish especially if those rules are are in contravention of any of the above legislation. I believe the above was demonstrated comprehensively when the forum was closed last August while the code of conduct was rewritten to bring the forum in line with current Australian legislation. One person was also banned from the forum for a period for his harassment and bullying of others when that matter was brought to the attention of the N3V management along with their legal obligations towards forum members protection

At the risk of being wrong (again!), that is not exactly my recollection of those events. I don't believe that complying with any Australian legislation had anything to do with the temporary closure of these forums last year - it was simply a case of the bullying, harassment and abuse that was going on back then getting "out of hand". N3V, in their post to everyone, referred to a need for a "cooling off" period while they looked at the tightening their CoC.

The Australian legislation that people are probably referring to in posts here is the Racial Discrimination Act (1975) which was passed by Federal Parliament to override the confusing and inconsistent state laws that existed at that time. The law originated from the 1965 UN Racial Discrimination Convention which Australia ratified in 1975. The Act makes it illegal to discriminate against a person in a wide range of areas based on their race, colour, ethnicity, descent or national origin. Its most controversial ("controversial" to those on the extreme right of Australian politics and media) section (18C) outlaws any behaviour (including speech) that is designed to offend, insult, humiliate or intimidate individuals or groups based on their race, colour, etc. The current right wing Australian government has attempted to reverse this particular provision - it claimed that it was "an attack on freedom" - but its efforts were blocked by the Senate and, ironically, its need to pass "anti-freedom" laws of its own in the name of "defending us from terrorism".

In the 40 years of its existence, there has only ever been one prosecution under section 18C. A particularly obnoxious right wing media commentator was convicted under the Act of racial vilification in 2011.
