Reminder on SPORBUST's upgraded content - Read Please

A reminder to all that PRIOR permission from SPORBUST is required prior to releasing a public reskin of SPORBUST's content (Unless otherwise noted that it is ok to do so without permission in the licensing section).

Just because it has my KUID number on it does NOT mean that it is fair game.

Don't screw it up for all of us.....Because you will.

EDIT: I will be VERY cross with the person that causes all of my efforts to get S**t canned because they can't be arsed to read a licensing entry.

After the appearance of another one of SPORBUST's reskinned assets tonight, I guess I need to bump this thread.

Best to have permission from him instead of the alternative........................... He does still frequent the board here.....

These subjects can get touchy, when written messeges are misunderstood, so let me start with; I am 100% in agreement with you.

That said, I think this situation should have been foreseen, and maybe a better notice of such terms placed into the Files themselves. To the newer members, not familiar with certain creators that have moved away a bit, seeing all these "new" items of content is just too tempting, and they are not aware that certain people tend to be "controlling" of their publicly available content. (If anyone remembers me from Trainsim, you know I am one of them, so much so, that I have not released anything I've made for Trainz yet, and removed as much of my MSTS content as possible)

I don't think it should be assumed that persons who own and use Trainz(DLS) automatically participate in the Forums, and would there-fore read this "public notice", just as not all Registered Forum Members actually own and use Trainz(ie download from DLS)...they're somewhat mutually exclusive, for lack of a better term. I notice that you put this in the Files of some recent releases: " Mesh by SPORBUST, Reskin by Wyonate. Original Eula is still in effect. Repaired and uploaded by N8PHU with Permission." The problem here lies in the fact that the "original EULA" is not included in your re-release, and as such, the downloader has not a clue what those rules are, and if they do not read this thread, they may not fully understand that they must ask Frank first.

I would humbly suggest that you include Frank's FULL EULA in your future uploads, to avoid any possible misunderstanding. (If I missed the fact that Frank's EULA IS actually somewhere within your recent uploads, I'm sorry to have butted in :confused: )
 
What you are seeing is what I wrote as part of the description.... To see the Eula the config file needs to be viewed or to open the asset and open the config file which is what and individual would do once they open the asset to reskin it and put their name on it.

So in essence, once they open it to reskin it and put their name on it, the licensing statement is right there......... No way to miss it.

I left Franks licensing statement verbatim.......

And no, you didn't butt in... :)

First I also do not want to butt in but,
I wish to say that not every item uploaded that you have fixed does not a EULA.
One example would be:

Under the licence it only says Union Pacific.

My suggestion would be to add something like the one from the B40's of his.

b40-8 loco is non reskinable at this time. The trucks are freeware and are reskinable

If it were me I would add something like this to every item of his under his original EULA.

The problem is that with a licence that is empty some people will assume that the can do as they wish.

Guess this needs to be addressed.

I tried to get a hold of SPorBUST to get blanket permission for people to reskin his stuff that I have restored and put on the DLS.

As you all know SPROBUST has left. I haven't been able to get a hold of him for a couple of months now.

So it boils down to this: There are only a few people I know that have blanket permission to reskin. For those who were unfortunate enough not to get it, I do not know what to tell you.

I do not have authority to give out the reskin permission otherwise I would. I couldn't get it when I made the deal to do the repair uploads. I tried for it and didn't get it.

So, private reskins are fine, pics of private reskins are fine (seems silly not to be able to do that , eh?). Perhaps a few individuals who do have the blanket permission might be able to act as clearing houses for some reskins AS LONG AS THEY VOLUNTEER TO DO IT. I won't name names here. If they volunteer, that is up to them.

So, the bottom line is the likehood of anyone getting permission to reskin SPorBUST's stuff for the last few months is nil.
