I stumbled on this fabulous climax somewhere deep in the internet. I don't know exactly where I found it. I repainted it to the hillcrest climax 10. I mightbe wrong, but I think zapperjet made this.

All you need do is read the config file to see who made it, and then check the kuid against the DLS to see if it's hosted there.
It would be proper to give the original author definitive credit.

It's really more common courtesy than anything else.

It has a copyright, established automatically by the original creator, and you would be in violation of the copyright and possibly subject to legal action unless you have permission to modify it and redistribute it. Unless permission is specifically granted in the config file, you always need to ask.

Odd thing is, there is nothing in the config file about copyright, not even info about the loco. The spot where the copyright info is placed is empty.

It REALLY doesn't matter. I think it's better to wait until you hear from the owner rather than find out in court you were wrong.

There are many, many threads on this topic. Copyrights exist whether there's a license file there or not.

I guess it is best to play it safe and ask his permission. "Do unto others as you would want done to you." I think it is still in alpha stage. It sure runs to good to be in alpha stage. Why hasn't zapperjet seen this post? It is his loco.

What makes you think that he's seen this? I know it seems like a hassle, but no need to get off on the wrong foot with him.

I guess he isn't a regular on here. Makes me wonder, Why he didn't finish some of his stuff. Anyway, I'll give him a shout and see what I can do.

He left the community a while back, and stopped working on his models...just got tired of it all i guess. he has a model of Cass #5 in beta that doesn't work above TRS2006/TC1-TC2. everything else breaks it.

That is indeed the beta for ZapperJet's Climax.

He is currently busy with other projects, as far as his config and license go. Since it is still a BETA project certain things may not have been finished. Regardless he holds the rights to the use, distribution, and redistribution. Since it is also a Steamtrainz project let me make this clear: Should this, or any of our content be found on the DLS or any 3rd party site without our knowledge or expressed permission, it will be politely asked to be removed by the user, and if need be, will be taken to the site provider and removed by them. I guarantee if they have to remove it, they may remove your website altogether.

Always ask for permission, if you don't get a response then it's still a no.
