It is my understanding that if the watermark / copyright banner is showing, that the photos are in the public domain, and need no permission to post, unless you are advertising, or making monetary profit off of said copyrighted photos.

Yeah, I think cascade is right. We have a same deal with church music. You can take the sheet music legally if it says "sample" or something on the front of it. So he should be good to use that photo. However, I thought this was a trainz topic.
