Some do, and if they're empty I don't think that rule applies, I've seen a few autoracks humped before...

Those tanks are new and enroute to their new owners. There is a hump by-pass that is out of the picture to handle the "do not hump" car. Most cars that need special handling are switched out in the receiving yard.
