Possible Copyright breach of Australian videos & photos

It has come to our attention that an Australian Youtube & possibly photos user could be copying other people's train videos & photos without permission. He or claims that they he has the copyright to them, however I have seen a number of these videos & photos elsewhere before they were posted on his sites.

I won't post their username yet, but I do have the username on hand if you want more information.

Not sure if this should be moved to the community section or not.

Edit: Youtube has stated before that the person who has had their videos copied must notify Youtube.

This is because US copyright law requires that any action claiming infringement must be brought by the owner, or agent of the owner, of the copyright. No one else has standing to do so.

If you can prove the copyright infringement you suspect (for example, by providing a link to the original, and a link to the item you consider infringing), then in my view it's reasonable and proper to do one of two things:

1) notify the copyright holder of the infringement; or

2) post the facts in a public forum, and call out the infringer.

That's what Youtube suggests, to notify the owner[ and ask them to write to the Youtube member to remove it. And then if they don't, to notify Youtube.

Unless the video owner had to reupload the video, it's easy to which is the original, as that will have the oldest date on it.

While it shouldn't be needed, make sure the copyright is stamped on the videos and/or photos, but attempt to make sure it is hard for them to edit the copyright wording out, as some try to edit it out.
